The situation arose from performing by the fiscal authorities of tax audit of the client. As the result of the audit, violations of tax legislation and additional charges of taxes in total amount of UAH 247,983.00 were concluded in respective tax audit act.
Yet, at the stage of administrative (pretrial) appeal against tax audit act, our specialists managed to convince the fiscal authorities’ officials of unlawfulness of conclusions set forth in their tax audit act. In particular, as a result of consideration of the objections against unlawful tax audit act prepared by our lawyers, the fiscal authorities’ officials reached conclusions on rightfulness of provided by us grounds and on necessity to revise the conclusions of the mentioned tax audit act. Thus, no tax charges in the mentioned amount based on tax audit act were adopted.
Hence, as a result of administrative (pretrial) appeals against conclusions of unlawful tax audit act, the fiscal authorities, at their own discretion, reached conclusions on unlawfulness of additional charges of taxes in total amount of UAH 247,983.00 previously adjusted by them. Thereafter no tax decisions on tax charges in the mentioned amount were approved.
