ARTESLEX team has advised the company engaged in construction and real estate business regarding the legal options of acquisition of the land plots under the real estate objects owned by the client.
The situation arose because of the client’s decision to order the construction of the real estate. However, due to misunderstanding with the developer, the client did not receive the expected land plots under such real estate objects. Therefore, we were requested to provide a legal opinion, which is needed to the client in order to determine the risks and to analyse the legal ways of acquisition of the land plots under the real estate objects by means of legal action, as well as by the pre-trial settlement of the dispute.
During provision of the mentioned services, particular attention has been paid to practical application of the Ukrainian legislation governing such matters, with the aim of possible risk minimization. In addition, comprehensive analysis of the court practice has been made in respect of the possibility of potential court dispute.
