Another criminal proceeding in relation to tax authorities’ officials is initiated

ARTESLEX attorneys have represented the company in field of wholesale trade in respect of binding the prosecution service to initiate criminal proceedings and launch pre-trial investigation in relation to tax authorities’ officials guilty of breach of the company’s rights during performing of tax audit of the company.

Such situation arose from our specialists’ addressing with a range of applications to the prosecution service, law‑enforcement authorities, fiscal authorities with applications on criminal offence by tax authorities’ officials during performing of tax audit of the company. Such application were purposed to bring out the facts of unlawful activity of tax authorities’ officials and to bring guilty persons to responsibility. Yet, the prosecution service denied, in violation of law, to initiate criminal proceedings and launch pre-trial investigation further to respective application.

Thus, our specialists launched judicial appeals against unlawful actions of the prosecution service. As a result of such appeals The Court ruled and declared the action of the prosecutor unlawful and bound the prosecution service to initiate criminal proceedings and launch pre-trial investigation in relation to tax authorities’ officials guilty of breach of the company’s rights during performing of tax audit of the company.

As a result of the performed work, criminal proceeding has been initiated and pre-trial investigation in relation to tax authorities’ officials has been launched. The investigation is ongoing at this stage.
