ArtesLex Law Firm team has provided comprehensive legal support to the company carrying out activity in the field of recyclable materials trade, within the court case on cancelation of the tax authorities’ order for the scheduled tax audit.
The situation arose because of receiving by the client of the abovementioned order from the tax authorities. Since such order had been of obvious illegal nature, we immediately initiated legal action purposed to its cancelation.
Particular importance to this case had been given by the fact, that the tax authorities had actually performed the tax audit of the client, even though they had been repeatedly informed about its unlawfulness, as well as the order for such audit had been appealed to court yet before the commencing of the audit.
As the result of the audit, the client had been additionally charged with the tax obligations amounting to UAH 6,635,685.00. We had immediately appealed against these additional charges to court as well. Thus, our attorneys initiated suspension of the court case on cancellation of the tax charges until the final resolving of the court case on cancelation of the order for respective tax audit. Such our grounding had been based on the reasoning, that cancelation of the order for the tax audit results in cancelation of all the tax additional charges made further to such tax audit, irrespective of the subject matter and the grounds of the tax additional charges.
Thus, as a result of court hearing in respect of our client’s claim against tax authorities as initiated by the lawyers of our firm, The Court delivered a Judgment that is in favour of our client: the tax authorities’ order for the scheduled tax audit was ruled illegal and cancelled.
