ARTESLEX specialists have successfully stood upon the rights of the company carrying out activity in the field of wholesale trade of aesthetic medicine goods, within the case on binding the prosecution service to register criminal proceedings and to carry out pre-trial investigation upon the facts of illegal actions of the fiscal authorities’ officials against the client and breach of the taxpayers’ rights.
The situation arose because of, as it came to the client’s knowledge, visiting by the fiscal authorities’ officials of the places of business and companies of the customers purchasing goods imported by the client. During such visits the mentioned officials spread information about ‘fake’ business of the client and urged those customers to cease further cooperation with the client.
Unwilling to put up with such abuse, we addressed to the prosecution service with an application on criminal offence upon obstruction of legal business activities of the client, done by the fiscal authorities’ officials using their official position, as well as upon abuse of power by them. However, the prosecution service denied, in violation of law, to register the criminal proceedings based on the application on criminal offence.
Thus, our specialists launched judicial appeals against unlawful denial of the prosecution service to register the criminal proceedings. Yet, during legal proceedings the prosecution service have, without waiting until The Court delivers judgement, at their own discretion, registered the criminal proceedings and provided our attorney with an extract from register confirming registration of the criminal proceedings.
Thus, due to engagement of our lawyers, the prosecution service were forced to register the criminal proceedings and initiate a pre-trial investigation upon the facts of illegal actions of the fiscal authorities’ officials guilty of breach of the taxpayers’ rights.
