Successful Resolution of Another Tax Litigation in Favor of the Client

The legal team of ARTESLEX has successfully defended the client’s interests in a dispute with the tax authorities, who attempted to unjustifiably impose additional tax liabilities and penalties in the total amount of UAH 250,000.00.

The essence of the case was that the tax authority issued a tax notice-decision, by which the client was unlawfully charged with penalties for alleged violations of legislation in the sphere of production and circulation of alcoholic beverages and tobacco products, as well as for conducting retail trade of fuel without the required license. Our lawyers prepared an administrative claim, in which we substantiated the unlawfulness of the tax authority’s position and demonstrated the absence of any legal grounds for such additional assessments.

As a result of the case review, the District Administrative Court fully upheld the legal arguments set out in the claim, declared the actions of the tax authority unlawful, and annulled the tax notice-decision together with all additional tax liabilities. Consequently, the client avoided unjustified financial losses and was able to preserve resources for further business development.
