ArtesLex legal team acted as counsel to a client in connection with a project involving the conclusion of a contract with a non-resident counterparty operating across multiple European Union jurisdictions.

Given the cross-border nature of the engagement, the client requested legal advice regarding the applicable provisions of European Union employment law that could affect the regulation of legal relations with the counterparty, as well as the rights of employees involved in the performance of the contract. Our advisory support was provided throughout all phases of the project — from the preparation of an initial legal opinion to the finalisation of all contractual terms.

In the course of our engagement, we recommended an optimal solution from the perspective of legal certainty, regulatory transparency, and tax efficiency. Particular attention was paid to the applicability of rules concerning posted workers, social guarantees, occupational health and safety requirements, and relevant norms of international tax law.

The final stage of the advisory process involved drafting and finalising the contractual provisions in a manner that reflects the requirements of the selected jurisdiction and protects the client’s interests. This included detailed regulation of the parties’ rights and obligations, termination procedures, confidentiality arrangements, dispute resolution mechanisms, and liability clauses.
