Land plot owner’s interests have been protected in a commercial dispute with the developer

The lawyers of ArtesLex have successfully stood upon the rights of the client operating in the field of real estate transactions in a dispute with the tenant of his land plots.

The situation arose from concluding by our client, as the owner of a number of land plots, on the one hand, and the tenant, on the other hand, a number of emphyteusis agreements, pursuant to which the client provided the tenant with land plots for use for the purposes of growing agricultural crops. However, at the stage of performing of the agreement, the client had claims against the tenant in terms of non-fulfillment of certain contractual obligations relating to payment and compensation for damages caused.

Our specialists were urged to proceed with performing of protection of violated rights and elaborated an effective strategy of the conflict settlement. In particular, legal actions were initiated purposed to terminate the emphyteusis agreements illegal and to recover the damages caused to the client by the tenant. Also criminal proceedings in respect of the tenant’s officials upon fraud and falsification of documents were initiated.

Eventually, as a result of the entire job performed, we managed to force the tenant to accept all the claims put forward by the client, to recognize the client’s lawsuit and to make all disputed payments and reimburse the losses incurred by the client, as well as generally resolve all problematic issues.

Subsequently, our specialists have performed drafting of approval documentation between all parties concerned as to the conditions of reconciliation, provided legal support during preparation of documents aimed for formalization of the arrangements reached, as well as provided actual support during execution of the documents fulfilment of the obligations undertaken by the parties.
