The lawyers of ArtesLex have successfully stood upon the rights of the client operating in the field of real estate transactions in a dispute concerning the termination of the emphyteusis agreements.
The situation arose from concluding by our client, as the owner of a number of land plots, on the one hand, and the tenant, on the other hand, a number of emphyteusis agreements, pursuant to which the client provided the tenant with land plots for use for the purposes of growing agricultural crops. However, at the stage of performing of the agreement, the client had claims against the tenant in terms of non-fulfillment of certain contractual obligations.
Our specialists were urged to proceed with performing of protection of violated rights and initiated the legal action before The Court with a claim to terminate the concluded emphyteusis agreements. As a result of court hearing in respect of our client’s civil claim, The Court delivered a Judgment in favour of our client and terminated all concluded emphyteusis contracts.
