Specialists of ArtesLex Law Firm have successfully represented a Client within the process of release his bank accounts from arrest imposed by the State Enforcement Service of Ukraine officer.
The situation arose from failure by the Client to pay by credit card during his stay abroad. Having connected with his servicing bank support division he found out that all his bank accounts had been arrested by the State Enforcement Service of Ukraine authorities. After that we managed to discover that respective arrest had been imposed within the enforcement proceedings initiated according to the tax authorities’ demand, regardless of the fact that the Client had not been notified on any tax obligation existence or on details of the enforcement proceedings.
Thus, a range of applications and petitions to the State Enforcement Service of Ukraine subdivisions were initiated by us aimed at immediate release the Client’s bank accounts from arrest. Besides, negotiations were held with the responsible state enforcement officer, during which the rules of the Law of Ukraine “On the Enforcement Proceedings” were explained to him, according to which the bank accounts cannot be arrested without respective court decision adopted. His particular attention was paid to possible legal consequences in case of failure by him to meet our rightful demands on immediate release the Client’s bank accounts from arrest.
As a result, all Client’s bank accounts have been released from arrest the next day, so that the Client could freely administer his own funds.
